Terms of Service

1. Agreement and Scope

These Terms of Service ("Terms") govern your access to and use of Zon's mobile application for iOS (the "App") and our website and web application at justzon.com (including related subdomains and authenticated areas) (together, the "Services").

By creating an account, downloading or using the App, or accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Services.

Depending on how you use the Services, additional terms may apply from Apple (App Store), Stripe (payments), or other integrated platforms; those terms are between you and the respective provider where stated.

Acknowledgement regarding Apple Inc. (iOS)

If you access the Services through the App distributed via the Apple App Store, you acknowledge that these Terms are between you and Zon only, not Apple. Zon, not Apple, is responsible for the App and its content, except as required by Apple's App Store rules. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of Section 11 below to the extent required by Apple's standard EULA terms for App Store apps.

2. Description of the Services

Zon provides a fitness platform that may include, depending on your account type and product configuration:

Training: logging workouts, programs, templates, progression, stats, and optional integrations such as Apple Health (HealthKit) or GPS workout features for cardio and running sessions where enabled.
Community: feed, tribes or groups, social interactions, and in-app messaging (text and images).
Gamification: experience points, levels, achievements, duels or challenges.
AI-assisted features: automated coaching-style chat, post-workout analysis, imports, weekly summaries, and similar tools. Outputs are generated automatically and may be incorrect or incomplete.
Coach tools (web): dashboards to manage athletes, programs, offers, billing relationships, team workspaces, and related workflows.
Marketplace-style flows: athletes may purchase or subscribe to coach-defined offers; coaches may subscribe to Zon coach software where offered. Payments are processed by our payment partners as disclosed at checkout.

We may modify, suspend, or discontinue features with reasonable notice where practicable, or immediately where required for security, legal compliance, or operational reasons.

3. Eligibility and Accounts

You must be at least 13 years old (or the age of digital consent in your country, if higher) to use the Services.
You must provide accurate registration information and keep it updated.
You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@justzon.com if you suspect unauthorized access.

4. Medical Disclaimer and Assumption of Risk

Zon is not a medical provider. Physical activity involves inherent risks.

The Services are for informational, educational, and motivational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.
Consult a qualified healthcare professional before starting or changing an exercise program, especially if you have medical conditions.
Stop exercising and seek medical attention if you experience pain, dizziness, chest discomfort, or other warning signs.
You assume all risks associated with your use of the Services and any training you perform. To the fullest extent permitted by law, Zon is not liable for injuries or health issues arising from your use of the Services or reliance on any content or AI output.

5. AI Features

The Services may use artificial intelligence to generate text, summaries, suggestions, or structured data.

No guarantee of accuracy: AI outputs can be wrong, outdated, or inappropriate for your situation.
Not human coaching: Unless explicitly stated in a specific product, AI interactions are not real-time human supervision by a licensed professional.
No emergency use: Do not use the Services for emergencies. Contact emergency services if needed.

6. Subscriptions, Purchases, and Payments

6.1 In-App Purchases (iOS) — Auto-Renewable Subscriptions

Title and Content: ZON Pro is the auto-renewable subscription offered within the App. ZON Pro unlocks advanced training features, nutrition tracking, AI coaching tools, and analytics within the Services.

Subscription Duration and Pricing:

Monthly: renewed every 1 month at the price displayed on the App Store
Quarterly: renewed every 3 months at the price displayed on the App Store
Annual: renewed every 12 months at the price displayed on the App Store

Exact prices for each subscription are shown in the App and on the App Store product page before purchase confirmation.

Payment and Billing: Payment will be charged to your Apple ID account at confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.

Managing and Canceling Subscriptions: You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Cancellation will take effect at the end of the current paid period. Cancellation of the current active subscription period is not allowed.

Free Trials: If applicable, any unused portion of a free trial period will be forfeited when you purchase a subscription. Free trials are subject to the terms shown at purchase.

Refunds: Refund requests for App Store purchases are handled under Apple's policies. Zon does not control Apple's refund decisions. To request a refund, contact Apple Support directly.

Entitlement Management: Subscription entitlements may be synchronized via RevenueCat for entitlement management.

6.2 Web Payments (Coaches and Coach Offers)

Coach SaaS subscriptions and other web-based transactions on justzon.com may be processed through third-party payment providers, subject to their own terms. These web payments are separate from in-app purchases and do not affect your iOS subscription.

6.3 Taxes and Pricing

Prices may exclude taxes unless stated otherwise. You are responsible for any taxes imposed on your purchases as required by law.

7. User Conduct and Content

7.1 Acceptable Use

You agree not to:

Violate law or third-party rights
Harass, threaten, defraud, or harm others
Post illegal, hateful, violent, sexually explicit (where prohibited by our rules), or spam content
Attempt to hack, scrape, overload, or reverse engineer the Services except where applicable law forbids this restriction
Misrepresent your identity or affiliation
Collect user data without consent or bypass security or access controls

7.2 Moderation

We may remove content, suspend or terminate accounts, or limit features if we reasonably believe you violated these Terms or pose a risk to the community.

7.3 License You Grant to Zon

By submitting content (text, images, workout data you choose to share publicly, etc.), you grant Zon a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely as needed to operate, promote, and improve the Services. You retain ownership of your content subject to this license.

You represent that you have the rights to grant this license and that your content does not violate law or third-party rights.

7.4 Public and Coach-Visible Information

Profile fields, public posts, showroom pages, or coach-facing data may be visible to other users or coaches according to your settings and product behavior.

8. Intellectual Property

The Services, including software, design, branding, and documentation, are owned by Zon or its licensors. Except for the limited rights to use the Services under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, or lease our intellectual property without prior written consent.

9. Third-Party Services

The Services integrate third-party services (for example Supabase, Stripe, Apple, Google, OpenAI, RevenueCat, PostHog, Resend). Your use of those services may be subject to their terms. Zon is not responsible for third-party services outside our reasonable control.

10. Termination

By you: You may stop using the Services at any time. You may delete your account in the App on iOS and Android via Settings → Danger Zone → Delete Account; web accounts may offer equivalent controls where implemented.

By us: We may suspend or terminate your access if you materially breach these Terms, if we must comply with law, or if we discontinue the Services (with reasonable advance notice where feasible).

Upon termination, certain provisions survive (including disclaimers, limitations of liability, and governing law) as needed to give them effect.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ZON AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) ONE HUNDRED EUROS (€100) OR (B) THE AMOUNTS YOU PAID TO ZON (NOT TO THIRD PARTIES SUCH AS COACHES OR APPLE) FOR THE SERVICES DURING THAT PERIOD.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Zon and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your violation of these Terms or law.

14. Governing Law and Disputes

These Terms are governed by the laws of France, without regard to conflict-of-law principles. Courts located in France have exclusive jurisdiction over disputes arising from or relating to these Terms, subject to mandatory consumer protections in your country of residence where they cannot be waived.

15. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date and, where appropriate, provide additional notice. If you continue to use the Services after changes become effective, you accept the revised Terms. If you do not agree, stop using the Services.
